How long does it take for FMS to send arrears after tax refund is intercepted?

My ex’s Federal tax refund was intercepted for child support arrears. He had to call the FOC tax unit to authorize the return go toward arrears. According to FOC they sent the payment authorization to FMS on 4/29/08.Anyone know how long before I get it?

if his refund has been processed and offset already and he doesn’t owe any federal debts such as student loans,back taxes or anything and did not file a joint return with a spouse it may only take 1 month to receive,and if you don’t owe anything like that also,or you wasn’t or is on public assistance b/c if so they will keep a portion or all to cover what they have paid you.
if he’s married and filed jointly they will hold it for 6 months to give the spouse time to file injured spouse to get their portion of the refund check.she can sign a paper to tell them she doesn’t want her half so you can receive it faster than 6 mos.
btw,if his refund does not cover his debt his rebate will be offset also and given to you also.

Up to 6 months if FMS doesn’t know his filing status. The IRS cannot tell FMS anything about the return that he filed so unless he tells them that he has not filed a joint return and there is no current spouse that might file an Injured Spouse claim they have to sit on it to give a possible spouse time to file the claim.
If they know about his marital status then it can be paid over to you in as little as 4 to 6 weeks.
